Terms and Conditions
In this agreement:
ASADA means the Australian Sports Anti-Doping Authority, a body corporate
established by section 6 of the Australian Sports Drug Agency Act 1990 (Cth) and
continued in existence by force of section 20(2) of the Australian Sports Anti-Doping
Authority Act 2006 ABN 91 592 527 503 of Unit 6, 5 Tennant Street, Fyshwick ACT
ASADA Website means the ASADA internet website accessed and used by third
parties who wish to check the status of Australian medications and substances in
Database means the MIMS Medicines Database owned or licensed by UBM.
UBM means UBM Medica Pty Limited (ABN 68 050 695 157) of 3rd Floor, 1 Chandos
Street, St Leonards NSW 2065 Australia.
You or Your means the person who accesses and/or uses, relies in the
information or classification contained in the Database or the ASADA website.
The Database is used within the ASADA website and provides information on the use
in sport for the most commonly prescribed, over the counter and complimentary medicines
in Australia. The information has been produced by the review of the TGA approved
prescribing information and product packaging (where appropriate). Any omissions
are due to the necessary information not being available to UBM at the time of publication.
The Database used on this ASADA website also includes information supplied by ASADA.
This information has been chosen by ASADA for publication because ASADA believe
it to be reliable.
To the fullest extent permitted by law UBM accepts no liability whatsoever for the
clinical decisions taken by You or Your selection of a therapy. The use of the Database
or the ASADA website does not replace the professional judgement of a health care
You acknowledge and agree that the Database includes information which is subject
to specific health legislation and regulations in Australia. UBM has taken reasonable
measures to ensure that the information contained in the Database complies with
Australia’s health regulations and codes of practice.
You acknowledge and agree that the information referred to in the Database is specific
to Australia and may not be available or permitted in any other jurisdiction other
You acknowledge and agree that the Database provides:
- information on the most commonly prescribed medicines in Australia, such information
having been produced by UBM’s review of prescribing information and product packaging
that has been approved by the regulatory authority (where appropriate);
- abridged information having been produced by the review of published primary and
secondary medicine literature; and
- abridged information on medicines available in Australia, such information having
been produced by the review of third party data sources, including the approved
In each case, any omissions are due to the necessary information not being available
to UBM at the time of publication. Although every reasonable effort has been made
in compiling and checking the information in the Database to ensure that it is accurate.
UBM makes no representation or warranty that all content or information is complete,
up to date or appropriate and assumes no legal liability or responsibility for the
accuracy, currency or completeness of any information in the Database.
The Database includes information provided by third parties. This information is
identified with the name of the source and has been chosen for publication because
UBM believe it to be reliable. The Database may also contain links to internet sites
maintained by third parties over which UBM has no control, nor does UBM have full
knowledge of the content of such sites. To the extent permitted by law, UBM, its
employees and agents accept no liability (including negligence) for any injury,
loss or damage caused by the reliance on any part of this third party information.
